Terms and conditions

The following terms and conditions apply exclusively to business transactions between Combo AG and the customer. They shall in all cases take precedence over any conflicting terms and conditions submitted by the customer or contained in the customer’s documents.

Prices

Unless otherwise stated, all prices are expressed in Swiss francs. As a general rule, prices for domestic deliveries include VAT, while prices for international deliveries exclude VAT. All prices are approximate, and only the most recent quote is valid for 30 days, unless there are clerical, printing, or calculation errors.

Deliveries

Shipping and handling are free for domestic shipments of therapeutic devices. For international shipments, only the postage will be charged. In the event of late deliveries, no claims for damages—including lost profits, business interruption, or any other financial losses—may be asserted against Combo AG.

Payment Terms

As a general rule, orders will only be processed if the amount due is paid in advance by bank transfer to our account.

Warranty conditions

Combo AG is responsible for rectifying all defects attributable to material or manufacturing defects. The warranty covers the repair of the instrument free of charge or the replacement of defective parts at no cost. Excluded are claims for rescission, reduction in price, replacement of the instrument, reimbursement of costs incurred for repairs performed by third parties without our written consent, and, finally, damages exceeding the cost of replacing the defective part. Travel and shipping costs to the customer will be billed.

The invoice or delivery slip from Combo AG, which must include the date of purchase and the model, serves as proof of the warranty claim.

The warranty does not cover parts subject to normal wear and tear, nor does it cover defects caused by improper operation or use—such as rental—or by external influences. Furthermore, the user is obligated to inspect all moving parts, as well as screws and rivets, for wear and tear at regular intervals of one week; failure to do so will result in the user forfeiting any right to compensation for consequential damages.

If repairs or attempted repairs are performed by anyone other than Combo AG, the warranty claim is void.

Combo AG provides a 24-month warranty—even for commercial use—effective from the delivery date of the brand-new instrument.

Intended Use of the Purchased Item

Unless the shipping documents explicitly state that the equipment is intended for „professional users“—and the device is therefore covered by a public treatment license—the license is limited to private use of the therapy device for personal purposes. Commercial use of the equipment is prohibited in this case, as the commercial treatment of patients always requires proper training by the manufacturer and the use of professional-grade equipment.

Furthermore, this license strictly prohibits the licensee from making any modifications or alterations to GIGER® MD® instruments without the licensor’s written consent!

Transferability of Therapy Support

The therapy support provided by Combo AG is intended exclusively for the original purchaser or licensee of the instrument and is non-transferable. The right to therapy support may not be transferred to third parties, particularly in the event of a resale or transfer of the instrument to another person or organization. In the event of a change in ownership, the right to therapy support expires unless otherwise expressly agreed in writing with Combo AG.

Software product, know-how

The software product for the GIGER® MD® instruments and the related know-how may only be used within the scope of the applicable license agreement.

Disclaimer

Combo AG reserves the right to disclaim all liability in the event of failure to comply with the operating instructions and general guidelines, or in the event of improper use of the GIGER® MD® instruments.

Governing Law, Jurisdiction, and Amendments

This agreement or declaration is governed exclusively by Swiss law. The place of enforcement and the exclusive venue for all disputes arising in connection with this agreement or declaration is the registered office of Combo AG. However, this company is authorized to assert its rights at the customer’s place of business or before any other competent authority and, furthermore, to choose the applicable national law. Any amendments to these General Terms and Conditions must be made in writing.
